Terms of Service | Keep the Westbank Beautiful

These Terms of Service ("Terms") govern your access to and use of the Keep The Westbank Beautiful website (the "Site"). Keep The Westbank Beautiful ("KWB," "we," "us," or "our") is a Louisiana 501(c)(3) nonprofit organization. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Who We Are and What the Site Does

The Site provides information about KWB programs and events and may allow users to:

Submit community issue reports (including text, photos, locations, and comments)

View community-submitted reports and related content

Donate to support KWB

2) Eligibility

You must be at least 13 years old to use the Site. If you are under 18, you represent that you have permission from a parent or guardian to use the Site.

3) User Content and Community Reports

The Site may allow you to submit content ("User Content"), including issue reports, photos, locations, comments, and other materials.

By submitting User Content, you agree:

Be respectful: Use tolerance, kindness, and constructive language. No harassment, threats, hate speech, profanity, or personal attacks.

Be lawful and accurate: You will not submit content that is unlawful, misleading, defamatory, or fraudulent.

No sensitive personal data: Do not post private or sensitive information about yourself or others (e.g., phone numbers, personal emails, financial information, medical details, information about minors, or private home addresses of individuals unless necessary and appropriate for describing a public issue and permitted by law).

No impersonation: Do not pretend to be someone else or misrepresent your affiliation.

Moderation: KWB may (but is not required to) review, edit, remove, or refuse to post User Content at any time for any reason, including if it violates these Terms or our community standards.

No guarantee of response: Submitting a report does not guarantee that KWB or any agency will respond, fix, or address the issue.

4) License You Grant to KWB

You keep ownership of your User Content. However, by submitting it, you grant KWB a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify (for formatting, display, or safety/privacy), publish, display, and distribute your User Content in connection with operating, promoting, and improving the Site and KWB's mission (including on social media and in reports or communications).

You represent that you have the rights to grant this license and that your User Content does not violate any third-party rights.

5) Reporting Concerns

If you believe content on the Site is inaccurate, inappropriate, or infringes your rights, contact us at: info@keepwestbankbeautiful.org. For emergencies or immediate public safety concerns, contact local authorities.

6) Donations

Donations may be processed by third-party payment processors.

You agree to provide accurate donation and billing information.

Donations are generally non-refundable, except where required by law or if a processing error occurs. If you believe there was an error, contact us at info@keepwestbankbeautiful.org within a reasonable time.

KWB is a 501(c)(3) nonprofit; donation tax deductibility may depend on your individual circumstances. Please consult a tax professional.

7) Volunteer and Event Participation

Volunteer opportunities and events may carry inherent risks. By registering or participating, you agree:

You participate voluntarily and assume responsibility for your actions.

You will follow event rules, safety guidance, and applicable laws.

KWB may refuse participation or remove anyone for safety or conduct reasons.

Additional waivers may apply for specific events and will be provided when required.

8) Intellectual Property

The Site and its content (excluding User Content) are owned by or licensed to KWB and may include trademarks, logos, text, graphics, photos, and software. You may not copy, modify, distribute, or create derivative works from Site materials without our prior written permission, except as allowed by law.

9) Prohibited Uses

You agree not to:

Violate any law or regulation

Interfere with or disrupt the Site or servers

Attempt unauthorized access to accounts, systems, or data

Submit malware, spam, or automated scraping

Use the Site to harass, defame, or harm others

Use the Site in a way that could damage KWB's reputation or operations

10) Third-Party Services and Links

The Site may include links to third-party websites or services (e.g., donation processors, social media platforms). KWB does not control and is not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

11) Disclaimers

The Site and all content are provided "as is" and "as available." To the fullest extent permitted by law:

KWB makes no warranties of any kind (express or implied), including accuracy, reliability, or fitness for a particular purpose.

Community-submitted reports are provided by users. KWB does not verify, endorse, or guarantee these reports.

12) Limitation of Liability

To the fullest extent permitted by law, KWB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Site, even if KWB has been advised of the possibility of such damages.

To the fullest extent permitted by law, KWB's total liability for any claim related to the Site will not exceed $100 (or the minimum amount allowed by law, if greater).

13) Indemnification

You agree to defend, indemnify, and hold harmless KWB and its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

Your User Content

Your violation of these Terms or any law or third-party rights

14) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you violated these Terms or for any reason to protect the Site, users, or KWB.

15) Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the Effective Date. Your continued use of the Site after changes means you accept the revised Terms.

16) Governing Law and Venue

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Site will be brought in the state or federal courts located in Jefferson Parish, Louisiana (or the appropriate parish/county), and you consent to that jurisdiction.
